General Overview
- 1983: A judge found that Trump had used spurious litigation to harass a tenant he was hoping to evict from one of his buildings. “A judge said yesterday that Donald Trump, the New York real-estate developer, had tried to ‘harass’ a tenant into moving out of a Central Park South building Mr. Trump owns. Mr. Trump filed a '’spurious and unnecessary’ lawsuit against a tenant, Anderson Clipper, to force him out of his rent-stabilized apartment at 100 Central Park South, according to the judge, Jay Stuart Dankberg of Housing Court in Manhattan. The judge dismissed the lawsuit and ordered Mr. Trump to refund 5 percent of the rent paid by Mr. Clipper since January 1982. Mr. Trump said through a spokesman that he would appeal the decision. The spokesman, John Barron,said Mr. Trump wanted tenants to move out of the 15-story apartment tower, at the corner of Central Park South and the Avenue of the Americas, so that it could be demolished and replaced with another building. In his suit, Mr. Trump said that Mr. Clipper had failed to pay his $637 rent in August 1981. Judge Dankberg found, however, that Mr. Clipper had paid his rent on time - he had a canceled check dated Aug. 28, 1981.” (New York Times, November 10, 1983)
- January, 2017: Donald Trump was an active litigant in approximately 75 civil lawsuits when he was inaugurated U.S. President. “As citizens were voting Tuesday to elect billionaire Donald J. Trump the next U.S. president, lawyers and a judge dealt with new motions in a California court in what may be one of the most important of 75 or so open lawsuits involving Trump and his businesses. In fact, the past seven days saw a flurry of motions and rulings in one of the class-action lawsuits brought by former Trump University students, who say the Republican president-elect's company ripped them off for tens of thousands of dollars in tuition for a sham real-estate course. The Trump University cases are among the most serious because they involve allegations of fraud and racketeering.” (USA Today, November 10, 2016)
- Before Trump took office, experts predicted that a judicial finding of fraud by Trump could precipitate impeachment proceedings against him. “Among the other cases are a $4 million lawsuit brought by a Republican political consultant who said Trump defamed her; a class-action claiming his presidential campaign broke consumer protection laws by sending unsolicited text messages to people's cellphones; and a suit by a golf club employee who says she was fired after complaining to her bosses about sexual harassment. […] ‘If the fraud and racketeering allegations against President-elect Trump are true, he is legally impeachable for high crimes or misdemeanors,’ said Christopher Peterson, a law professor at the University of Utah who has researched the Trump University cases, who acknowledged that while that's technically the case, a Republican-controlled Congress makes proceedings unlikely. ‘Whether he is politically impeachable is another matter.’” (USA Today, November 10, 2016)
- Donald Trump has been a party to at least 3,500 lawsuits, far more than any other previous candidate for U.S. President. “Donald Trump is a fighter, famous for legal skirmishes over everything from his golf courses to his tax bills to Trump University. Until now, it hasn't been clear precisely how litigious he is and what that might portend for a Trump presidency. An exclusive USA TODAY analysis of legal filings across the USA finds that the presumptive Republican presidential nominee and his businesses have been involved in at least 3,500 legal actions in federal and state courts during the past three decades. They range from skirmishes with casino patrons to million-dollar real estate suits to personal defamation lawsuits. The sheer volume of lawsuits is unprecedented for a presidential nominee. - A review of cases found that Trump won at least 450 and lost at least 38, while the resolution of most cases was not clear from the available public records. “Among those cases with a clear resolution, Trump's side was the apparent victor in 451 and the loser in 38. In about 500 cases, judges dismissed plaintiffs' claims against Trump. In hundreds more, cases ended with the available public record unclear about the resolution. Close to half the court cases -- about 1,600 -- involved lawsuits against gamblers who had credit at Trump-connected casinos and failed to pay their debts. About 100 additional disputes centered on other issues at the casinos. Trump and his enterprises have been named in almost 700 personal injury claims and about 165 court disputes with government agencies. Dozens dealt with the bankruptcy proceedings of Trump's companies, and dozens more were plaintiffs' lawsuits against Trump businesses that judges terminated because the Trump companies targeted had gone bankrupt.” (USA Today, June 2, 2016)
- Trump joined at least 70 new lawsuits during the first year of his presidential campaign, with approximately half the lawsuits being initiated by Trump or entities under his control. “Since he announced his candidacy a year ago, at least 70 new cases have been filed, about evenly divided between lawsuits filed by him and his companies and those filed against them. The records review found at least 50 civil lawsuits remain open even as he moves toward claiming the nomination at the Republican National Convention in seven weeks.” (USA Today, June 2, 2016)
- A review of Trump litigation found at least 100 cases that had settled, despite Trump's claims that he never settles cases. "Despite his boasts on the campaign trail that he ‘never’ settles lawsuits, for fear of encouraging more, he and his businesses have settled with plaintiffs in at least 100 cases reviewed by USA TODAY. - Many of Trump's lawsuits ended in settlements whose terms were not publicly disclosed. “The terms of most of the 100 settlements Trump and his businesses reached with plaintiffs have not been disclosed. - While Trump claimed his level of litigation was normal for his industry, a review of litigation records involving several rivals with similar businesses and net assets found Trump was a party to more lawsuits than all five competitors combined. "Even by those measures, the number of cases in which Trump is involved is extraordinary. For comparison, USA TODAY analyzed the legal involvement for five top real estate business executives: Edward DeBartolo, shopping center developer and former San Francisco 49ers owner; Donald Bren, Irvine Co. chairman and owner; Stephen Ross, Time Warner Center developer; Sam Zell, Chicago real estate magnate; and Larry Silverstein, a New York developer famous for his involvement in the World Trade Center properties. To maintain an apples-to-apples comparison, only actions that used the developers' names were included. History of Destroying Documents During Litigation
- A review of Trump's litigation history found that his companies had "systematically destroyed or hidden thousands of [documents] demanded in official proceedings, often in defiance of court orders." "Over the course of decades, Donald Trump's companies have systematically destroyed or hidden thousands of emails, digital records and paper documents demanded in official proceedings, often in defiance of court orders. These tactics—exposed by a Newsweek review of thousands of pages of court filings, judicial orders and affidavits from an array of court cases—have enraged judges, prosecutors, opposing lawyers and the many ordinary citizens entangled in litigation with Trump. In each instance, Trump and entities he controlled also erected numerous hurdles that made lawsuits drag on for years, forcing courtroom opponents to spend huge sums of money in legal fees as they struggled—sometimes in vain—to obtain records." - 1973: The Trump family refused to provide records demanded by the government after the company was indicted for unlawful racist discrimination against prospective tenants. "Courts have handed down severe sanctions or even criminal charges of obstruction of justice against executives and companies that destroyed records because they knew they were going to be sued. Yet when the government filed its standard discovery requests, the Trumps reacted as though seeking that information was outrageous. They argued in court that prosecutors had no case and wanted to riffle through corporate files on a fishing expedition. Once again, this led to more delays, more replies, more hearings...and another specious argument thrown out of court. Six months after the original filing, the case was nowhere because the Trumps had repeatedly ignored the deadlines to produce records and answers to questions, known as interrogatories. When a government attorney finally telephoned a Trump lawyer to find out why, he was told the Trumps had not even begun preparing their answers and had no plans to do so. The Trumps also postponed and blocked depositions, refused to provide a description of their records, as required, and would not turn over any documents." (Newsweek, October 31, 2016)
- Under oath in a deposition, Trump revealed that the Trump Organization had been systematically destroying incriminating records in what he characterized as a bid to 'save space' at the corporate offices. "Finally, under subpoena, Trump appeared for a short deposition. When asked about the missing documents, he made a shocking admission: The Trumps had been destroying their corporate records for the previous six months and had no document-retention program. They had conducted no inspections to determine which files might have been sought in the discovery requests or might otherwise be related to the case. Instead, in order to "save space," Trump testified, officials with his company had been tossing documents into the shredder and garbage. The government dashed to court, seeking sanctions against the Trumps. Prosecutors asked the judge to allow them to search through the corporate files or simply declare the Trumps in default and enter a judgment against them. - 2011: The Trump Organization falsely denied carrying liability insurance for a failed development project in Florida in order to forestall a settlement with defrauded investors that would have established a precedent in other fraud cases brought by similarly-defrauded investors. "In 2009, a group of plaintiffs claimed Trump duped them into buying apartments in a Fort Lauderdale, Florida, development by portraying it as one of his projects. The fine print of the dense and legalistic purchase contracts, however, revealed that Trump had agreed only to license his name to the developers, and when the project hit financial snags, he walked away from it. In their initial disclosures in 2011, Trump and his company said they had no insurance to cover any of their liability in this case. [...] At the time, a settlement in the then-prominent case could have been disastrous for Trump; he faced an array of similar lawsuits because he had licensed his name to developers around the world for projects that later collapsed. In each case, Trump had marketed the developments as his own, a claim contradicted by the sales contracts. A settlement in any of these cases might have encouraged other people who had lost deposits in a Trump-marketed development to file lawsuits against him. Two years after denying that Trump had insurance that could have been used to settle the Fort Lauderdale litigation, one of his lawyers made a startling admission: Trump and his company had been insured all along for up to $5 million." - 2005: Trump destroyed email records that would have established he had knowledge of a business rival's contract early enough that his legal challenge to it would have been barred by the statute of limitations and his attorneys lied to a court about the fate of the documents for years. "Perhaps the worst legal case involving Trump and his companies hiding and destroying emails and other records involved real estate developer Cordish Cos., which, through an affiliate called Power Plant Entertainment LLC, built two American Indian casinos in Florida. In January 2005, Trump Hotels and Casino Resorts sued in a state court almost immediately after the opening of the casinos, which both operate under the Hard Rock brand. In his lawsuit, Trump claimed that the companies had unlawfully conspired with one of his former associates to cheat him out of the deal; he argued that the projects should be turned over to him. [...] If Power Plant could prove Trump knew in early 2000 that his former associate was working on the Hard Rock deal, the case would be thrown out of court. The clock here for the statute of limitations starts ticking down when plaintiffs learn they have been swindled. [...] In a March 2006 response, Trump's lawyers argued that the emails and other electronic documents had not been produced because the company didn't have them. They claimed it had no servers until 2001—the year Trump claimed he had learned of the Power Plant project. [...] In response, Trump Hotels filed an affidavit from one of its information technology managers stating that it had had no servers prior to 2001. That was false and by deposing numerous IT specialists with two Trump companies—the Trump Organization and Trump Hotels—lawyers for Power Plant gradually chipped away at it. Finally, during a deposition nine months after he had signed the deceptive affidavit, the same Trump executive admitted his assertions in it were untrue." (Newsweek, October 31, 2016)
- The Trump Organization ordered the emails destroyed after litigation had been initiated and began a policy of systematically destroying records that could be subpoenaed in lawsuits. "These startling revelations changed nothing, however, because there was no trove of documents. The Trump records had been destroyed. Despite knowing back in 2001 that Trump might want to file a lawsuit, his companies had deleted emails and other records without checking if they might be evidence in his case. Beginning around 2003, the company wiped clear the data from everyone's computers every year. Lawyers for Trump Hotels had never sent out the usual communication issued during litigation instructing employees to stop destroying records that might be related to this case. The deletions continued, and backup tapes were reused—thus erasing the data they held. Power Plant lawyers also discovered that after the lawsuit was filed, Trump Hotels disposed of a key witness's computer without preserving the data on it." (Newsweek, October 31, 2016)
- The Trump Organization ultimately settled the lawsuit before facing consequences over its destruction of documents, agreeing to sell one of its casinos to the opposing party. "With the likelihood of sanctions growing, Trump Hotels dropped the suit a few months later, in part because of the company's financial troubles. A company involved in the Power Plant case agreed to purchase one of Trump's struggling casinos in Atlantic City, New Jersey, and included as part of the deal a requirement that the litigation be ended." History of Reaching Settlements, Then Disregarding Them
- The Trump Organization signed a settlement agreement with federal prosecutors requiring it to comply with anti-discrimination laws, then immediately resumed violating the laws and discriminating unlawfully against applicants based on their race. "In June 1975, more than 18 months after the government filed the case and with the Trumps still withholding potentially relevant records, the two sides struck a settlement. The agreement—which, like all civil settlements, did not contain an admission of guilt—compelled the Trumps to comply with federal housing regulations against discrimination, adopt specific policies to advance that goal, to notify the community that apartments would be rented to anyone, regardless of race, and meet other requirements. The Trumps ignored these requirements and still refused to rent apartments to minorities, something the government proved by sending African-Americans and non-Hispanic Caucasians to pose as applicants. - 1988: Donald Trump was a client of Sive Paget & Riesel, a Manhattan-based law firm that specialized in environmental litigation. “Indeed, environmental law has changed and broadened with the development of the ecological movement and the blurring of some adversarial lines. ‘Very few corporations are trying to fight the laws any more,’ said David Sive, a pioneer in litigation to end pollution of New York's Hudson River who, at the age of 65, is an elder statesman of environmental law. ‘Also the movement has passed the messianic stage to a phase of practical adjustments and tradeoffs where the problems are not who the good guys and bad guys are.’ Thus, Mr. Sive's 21-lawyer firm, Sive Paget & Riesel in Manhattan, represents such diverse clients as the Sierra Club and the Natural Resources Defense Council, on the one hand, and BFI Industries, the waste disposers, and Donald Trump, the developer, on the other, as well as New York City.” (New York Times, April 29, 1988)
- 1988: Trump was a client of a lawyer named Jack Nusbaum who worked for the firm of Willkie, Farr. “Jack Nusbaum of Willkie, Farr is one of the ‘hottest’ lawyers in mergers and acquisitions, with Donald Trump among his clients, the firm's publicist proclaims. ‘How and why he has become a 'superstar' would make an interesting story,’ he adds.” (New York Times, May 27, 1988)
- Donald Trump was a client of the law firm Finley, Kumble, which filed for bankruptcy and dissolved acrimoniously. “In the 1980s, the New York law firm Finley, Kumble threw out the rule books. Finley, Kumble did everything that prestigious law firms were not supposed to do. It raided other firms for partners; nabbed a highly publicized client list featuring Donald Trump, the state of Israel and Mobil Oil; and hustled for business such as wills, mortgage closings and incorporations that old-fashioned firms thought too minor to touch. Finley, Kumble has become one of the most influential law firms in the country - 250 partners, 450 associates, and offices in 16 U.S. cities , generating revenue of $200 million a year by the late 1980s. But its prominence was short-lived. - Donald Trump's condominium tower in West Palm Beach was once represented by an attorney named Charles Lubitz. “A prominent West Palm Beach law firm is fighting two lawsuits that, if lost, could lead to multimillion-dollar judgments against the firm and some of its partners. At a May jury trial, the Boose Casey Ciklin Lubitz Martens McBane & O'Connell firm will defend legal malpractice claims alleged by Thomas Dyer Sr., a real estate investor and mayor of Ocean Ridge; his wife, Sheila, and his partner Arthur Cote Sr. Dyer alleges faulty representation by the firm and/or its former partner Michael D. Gordon led to about $10 million in losses. […] Boose Casey has 11 equity partners. - 2000: Trump was represented by Tenzer Greenblatt, a law firm that merged with Blank Rome. “Blank Rome Comisky & McCauley, a button-down corporate law firm comfortable in the somber halls of power in Harrisburg and Center City, is adding a new service to its firm: high-profile divorce. The firm is merging with Tenzer Greenblatt in New York, an 80-lawyer firm with a surprisingly glamorous cast of divorce clients. They include Woody Allen, Howard Stern, Donald Trump and Joan Lunden. […] Tenzer Greenblatt reported revenues of $35 million in 1999, while Blank Rome had revenues of $106 million. - 1999: A law firm representing Trump looked at the possibility of dissolution due to financial pressures. Partners in Palm Beach County's largest law firm, Gunster Yoakley Valdes-Fauli & Stewart, have voted to make up rather than break up when confronted with a consultant's report that a split would be costly. In a resolution that became effective on Sunday, nearly all 50 of the equity and non-equity partners at the firm founded in Palm Beach 75 years ago decided to quash a coup that threatened to split off the firm's 38-lawyer Miami office. […] Gunster Yoakley, with 130 lawyers in seven offices in Florida that also includes Stuart, Palm Beach and Tallahassee, is one of the premier firms in South Florida. Its clients include U.S. Sugar, Office Depot, Donald Trump, Palm Beach National Bank, Levenger's and Telemundo Group, according to its Web site. (Palm Beach Post, October 14, 1999)
- Trump’s attorney at Gunster Yoakley was Louis Mracek. “Palm Beach County's largest law firm is suffering a shakeout in the wake of an aborted move to dump its Miami office. Two of the three lawyers at West Palm Beach-based Gunster, Yoakley, Valdes-Fauli & Stewart who led a failed effort to jettison the Miami office are leaving. And they're taking four other litigators with them. […] Louis Mracek and Stephen Page, both well-known litigators, told the firm's governing committee on Monday they'll leave next month, along with partner Roy Fitzgerald and associates Alan Rose, Scott Konopka and Elise Elder, according to knowledgeable sources. - September, 1986: Donald Trump’s law firm, Dreyer & Traub, opened up an office in Florida in order to follow Trump’s real estate investments in that state. “Richard Lehman, formerly of counsel with Finley Kumble in Miami, is setting up a Boca Raton office for Dreyer & Traub, the New York law firm that represents real estate developer Donald Trump. Lehman says the 100-lawyer firm now has four lawyers in Boca and plans to hire two more within a month. Trump, who snagged Palm Beach's sprawling Mar-a-Lago mansion for an estimated $5 million earlier this year, recently snapped up the financially troubled Plaza condominium in West Palm Beach for $40 million. ‘I don't think you can say the sole reason they're down here is Donald Trump,’ Lehman said. ‘They've started to get a smell for Palm Beach County and for what's happening in real estate here.’ So far, the New York office is continuing to handle Trump's Florida transactions, but someday the firm may let Boca go it alone ‘when they feel more comfortable with us,’ Lehman said. - May, 1988: Dreyer & Traub shuttered its office in Florida. “The 120-lawyer New York firm that opened a South Florida office in 1986 is folding up its deck chairs and leaving as of July 1. The firm, which represents multimillionaire developer Donald Trump, opened the office after the bad boy of New York real estate began expanding his empire south. Trump bought Palm Beach's fabled Mar-a-Lago mansion and West Palm Beach's bankrupt Plaza condominium across the lake. - Mitchel Maidman was a third-generation scion of a New York real estate dynasty who worked for ten years as a lawyer at Dreyer Traub, a law firm that represented Trump, before founding his own firm of Maidman Mittelman. “Townhouse Management Co. President Mitchel Maidman didn't get involved right away in the real estate firm his grandfather founded. Originally, he planned to be a lawyer. Although his father, Richard Maidman, who is the CEO of Townhouse,had followed in the footsteps of his father, William, who founded the company in 1933, Mitchel planned to focus on the legal aspects of real estate, even earning a law degree from Yale University. After graduation, he spent 10 years at Dreyer Traub, a real estate law firm that represented developers. Among the firm's clients were Leona Helmsley, Donald Trump and Peter Kalikow. IMPORTANT CAVEAT: Donald Trump has been a celebrity for more than forty years. Celebrities are often named in lawsuits filed by inmates and/or the mentally ill. We are going to use the term Frivolous Lawsuits to identify these cases. In some instances, these cases are anything but "frivolous" - they are often filed by people faced with serious and deeply sad problems.
